Terms & Conditions

1. General Terms

1.1. The owner of website www.krutstravel.com (hereinafter Website) is OÜ Kruts (hereinafter Seller). Information of the seller: Business registry code – 12893173; Address – Taela 9, 13521, Tallinn, Estonia.
1.2. Terms & Conditions apply to sales contract (hereinafter Contract) between a customer (hereinafter Buyer) and the Seller, when products are purchased from the Website.
1.3. Product information is displayed next to each product.
1.4. All the prices are displayed in euros.
1.5. Product prices do not include delivery. Delivery costs are additional. In case the Seller offers free shipping, the terms and conditions will be explained on the Website.
1.6. The Seller reserves the right to change the Terms & Conditions, products and prices. Seller will update the relevant information on the Website. The Terms & Conditions and prices valid at the time of transaction shall be applied.

 

2. Making a Purchase

2.1. To purchase products, the Buyer has to add desired products to shopping cart by clicking “Add to Cart” button.
2.2. To place an order, the Buyer has to click “Proceed to Checkout” button, then enter required data, choose shipping option and payment method.
2.3. The Buyer is obligated to enter true and correct data.
2.4. The Seller does not take responsibility for consequences that arise due to incorrect information given by the Buyer.
2.5. The total order amount to be paid is displayed in euros.
2.6. After the Buyer has entered and checked the correctness of required data, chosen shipping option and payment method, the Buyer must accept the Terms & Conditions and  place the order by clicking the button “Place order”.
2.7. The Buyer pays for the order directly with a debit or credit card, using a bank link or other available payment method.
2.8. The Contract enters into force after successful payment transaction.
2.9. When the payment is successfully transferred, the Seller will send a confirmation email to the Buyer’s email address.

 

3. Payment Methods

3.1. The Buyer can securely pay for the order with a debit or credit card (Visa, Mastercard or Maestro), which supports online payments.
3.2. Depending on the Buyer’s billing address, it is also possible to pay using Estonian, Latvian, Lithuanian or Finnish bank links (Swedbank, SEB, LHV, Danske, Krediidipank, Nordea, Citadele, Pohjala, Ålandsbanken, S-Pankki, Handelsbanken or Pocopay).
3.3. Card payments are processed outside of the Seller’s website, in secure payment processing environment provided by Maksekeskus AS.
3.4. The Seller does not have access to Buyer’s credit card nor bank details.
3.5. All transactions between the Buyer and the Seller are made in euros.

4. Shipping

4.1. Shipping costs are covered by the Buyer.
4.2. The cost of shipping depends on the Buyer’s location.
4.3. The shipping costs are displayed during checkout.
4.4 Domestic (Estonian) packages are delivered using Itella SmartPOST parcel terminals and will arrive at the destination terminal within 3-4 working days after the Buyer has successfully paid for the order.
4.5. International packages are shipped with Omniva (Eesti Post AS), using trackable maxi letters.
4.6 Shipments to European countries (Austria, Belgium, Bulgaria, Croatia, Spain, Netherlands, Ireland, Italy, Greece, Latvia, Lithuania, Luxembourg, Malta, Moldova, Norway, Poland, Portugal, France, Sweden, Romania, Germany, Slovakia, Slovenia, Finland , Great Britain, Switzerland, Denmark, Czech Republic, Ukraine, Hungary, Belarus, Russia) will arrive in the destination country within 4-10 working days after the Buyer has successfully paid for the order.
4.7 Shipments to the rest of the world will arrive in the destination country within 7-16 working days after the Buyer has successfully paid for the order.
4.8 International packages might delay (e.g. because of customs procedures) or be subject to additional costs, depending on the Buyer’s location (e.g. customs duty or import tax). It is the Buyer’s responsibility to be aware of the destination country’s regulations and to cover any additional costs, that might apply. The Seller is not responsible for any delays or additional costs, which are not affected by the Seller.
4.9. In case the Seller is not able to ship the order due to running out of stock or other reasons, the Seller must notify the Buyer immediately and refund total order amount (including shipping costs) as soon as possible, but not later than 14 days after the Buyer has received the notice.
4.10. Any shipping methods and/or special terms, that are offered as promotions, are explained on the Website – Shipping.

5. The Right of Withdrawal

5.1. Buyer has the right of withdrawal to return ordered products within 14 days, without any explanations. Starting from the day the Buyer or a person authorized by the Buyer (who is not the courier) has the product in their possession.
5.2. The right of withdrawal does not extend to business entities.
5.3. To use the right of withdrawal to return the products within 14 days, the Buyer must not use the ordered products in any other way than it is allowed in a physical shop to check the product’s nature, properties and functions.
5.4. The Seller has the right to deduct the refundable purchase amount proportionally to the decrease of the product’s value, if the product has been used in any other ways than it is allowed in a physical shop, shows marks of use or is damaged.
5.5. To use the right of withdrawal, the Buyer must submit a corresponding withdrawal request to email address shop@krutstravel.com, not later than 14 days after receiving the products from the courier or post office.
5.6. The shipping costs of the return are covered by the Buyer. Except, if the reason of return is a product not corresponding to the order (e.g. wrong or faulty product).
5.7. The Buyer must return the products to the Seller’s address (Taela 9, 13521, Tallinn, Estonia) within 14 days after submitting the withdrawal request or provide written proof (document), that the products have been handed over to a courier within aforementioned time.
5.8. The Seller will refund all order payments received on the basis of the Contract as soon as possible, within 14 days after the Seller has received the withdrawal request. The refunds are transferred to the same bank account from which the Buyer paid for the corresponding order.
5.9. The Seller has the right to refuse refunding payments until the Seller has received the products from the Buyer or until the Buyer has provided proof, that the products have been shipped, depending on which occurs first.

 

6. Complaints

6.1. The Seller is responsible for products, which do not correspond to the Contract or have faults, which existed at the moment the products were handed over to the Buyer and arise within two-year term after the products were handed over.
6.2. The Buyer has the right to submit a complaint to email address shop@krutstravel.com within two months after the fault has arisen.
6.3. The Seller does not take responsibility for faults nor damages, that arise after the product has been handed over to the Buyer or arise due to abnormal use. If the Seller is responsible for the faulty product or the product, which does not correspond to the Contract, the Seller shall repair or exchange the corresponding product. If it is not possible to repair or exchange the product, the Seller shall refund all costs related to the Contract. The Seller shall reply to the Buyer’s complaint within 15 days.

 

7. Privacy Policy

7.1 The Buyer gives the Seller a clear and acknowledged consent to process their personal data.
7.2 The personal data given to the Seller shall be entered into the customer registry and used for processing orders and delivering products to the Buyer.
7.3 The entered personal data is handled as confidential.
7.4 The personal information required for delivering the products to the Buyer will be forwarded to the company providing courier service.
7.5 The Seller may only use the Buyer’s personal data for sending special offers and newsletters to the Buyer’s email address, if the Buyer has given permission to do so.
7.6 Payments are processed outside of the Seller’s website in a secure payment processing environment of the corresponding bank or payment service provider. The Seller does not have access to the Buyer’s bank nor credit card details.

 

8. Resolving Disputes

8.1. Any complaints against the Seller should be sent to email address shop@krutstravel.com.
8.2. Any disputes should be resolved by reaching an agreement between the Buyer and the Seller. If the dispute can not be resolved by reaching an agreement, the Buyer may turn to the Consumer Disputes Committee. The description of the procedure can be found on their website. The Consumer Disputes Committee resolves disputes arising from the contracts between buyers and sellers. Reviewing the Buyer’s dispute is free of charge.
8.3. The Buyer may use the EU Online Dispute Resolution platform.
